Banke International Properties — Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Banke International Properties website, mobile applications, and related online services (collectively, the “Platform”). By using or accessing the Platform, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the Platform.

1. Acceptance of Terms

The Platform is operated by Banke International Properties (“Banke”, “we”, “us”, “our”). We may modify these Terms at any time by posting an updated version on the Platform. Continued use after such updates constitutes your acceptance of the revised Terms.

If you use the Platform on behalf of a business or organization, you confirm that you are authorized to bind that entity and that these Terms apply to both you and the entity.

2. Registration & Accounts

• Certain features may require you to create an account.
• You agree to provide accurate, current, and complete information and to update it as necessary.
• You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.
• Notify us immediately of any unauthorized use or security breach.

3. Scope of Services

The Platform displays property listings marketed exclusively by Banke International Properties. Only property owners or landlords may submit properties for potential listing, and all submissions are subject to verification and approval by Banke before publication. Third-party agents or brokerages may not upload or publish listings unless formally engaged by Banke. The Platform serves as an informational and marketing tool only. It does not facilitate transactions, payments, or contracts between users.

4. Property Submissions & Verification

By submitting a property, you confirm that you are the legal owner or an authorized landlord. You must provide accurate, truthful, and complete information including property details, images, and ownership documentation. Banke reserves the right to verify ownership, request additional documents, and accept, modify, or reject listings at its sole discretion. Once approved, the property will be marketed under the Banke brand. Approval does not guarantee a sale, lease, or specific response level.

5. Accuracy & Updates

Banke strives to ensure that property information and data published on the Platform are reliable. However:

• Property details, prices, and availability may change without notice.
• We do not guarantee the completeness or accuracy of any listing or content.
• Users should verify all property information directly with a Banke representative before making any decisions.

6. Permitted Use & Restrictions

You may access the Platform solely for personal, non-commercial purposes. You agree not to:

• Upload false or misleading property information;
• Infringe any third-party intellectual property or privacy rights;
• Use the Platform to transmit spam or malware;
• Copy, scrape, or harvest property data or contact information;
• Attempt to interfere with the security, functionality, or integrity of the Platform.

Any unauthorized use may result in termination of access and possible legal action.

7. Intellectual Property Rights

All rights, title, and interest in the Platform and its content—including text, design, software, photographs, graphics, and trademarks—are owned by or licensed to Banke. You may not copy, distribute, reproduce, or exploit any part of the Platform without Banke’s prior written permission.

8. User-Submitted Content

You retain ownership of any content you upload (such as property descriptions or images). By submitting content, you grant Banke a worldwide, royalty-free license to use, display, reproduce, and distribute it for marketing and promotional purposes. You warrant that you have full rights to your submitted content and that it does not infringe upon any third-party rights. Banke may remove or edit content at its discretion, particularly if found inaccurate or inappropriate.

9. Disclaimers

The Platform and its contents are provided “as is” and “as available”, without warranties of any kind, express or implied. Banke does not guarantee uninterrupted access, or that the Platform will be free of errors, viruses, or technical defects. Property outcomes (e.g., sale, rental, or enquiry volume) are not guaranteed.

10. Limitation of Liability

To the fullest extent permitted by law: Banke shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Platform or reliance on its content. Our maximum aggregate liability shall not exceed the total amount (if any) paid by you to use the Platform.

11. Indemnification

You agree to indemnify and hold harmless Banke, its affiliates, employees, and agents from any claims, damages, losses, or expenses (including legal fees) resulting from your violation of these Terms, submission of false or misleading information, or infringement of third-party rights.

12. Links to Third-Party Sites

The Platform may contain links to third-party websites. Banke does not endorse or control these sites and assumes no responsibility for their content, policies, or practices. Access to such links is at your own risk.

13. Termination & Suspension

Banke may suspend, restrict, or terminate your access to the Platform at any time if you breach these Terms or use the Platform unlawfully. Upon termination, your right to use the Platform ends immediately.

14. Governing Law & Jurisdiction

These Terms are governed by and construed under the laws of the United Arab Emirates. Any disputes arising from or related to these Terms or the Platform shall fall under the exclusive jurisdiction of the courts of Dubai, UAE.

15. Entire Agreement & Severability

These Terms, along with our Privacy Policy and any specific listing agreements, constitute the complete agreement between you and Banke regarding your use of the Platform. If any provision is deemed unenforceable, the remaining provisions shall remain in effect.
